Simbi Terms of Use

These terms apply to your use of the Simbi macOS application ("Simbi", "the app"), made by Andrew Sangwoo Ye ("I", "me"). By downloading or using Simbi you agree to these terms. If you do not agree, do not use the app.

1. License

Simbi's source code is open source under the MIT License (see LICENSE). The MIT License governs your rights to use, copy, modify, and redistribute the software itself. These Terms of Use do not restrict any right the MIT License grants you; they add the usage terms and disclaimers below for the app as distributed.

Simbi includes third-party software and models under their own licenses, listed in THIRD-PARTY-LICENSES.md.

2. Recording consent is your responsibility

Simbi can record your microphone and your Mac's system audio, including the other participants of calls and meetings. Laws on recording conversations vary by country and, in the United States, by state: many jurisdictions require the consent of all participants before a conversation may be recorded.

You are solely responsible for complying with all laws that apply to your recordings, including obtaining any legally required consent from everyone being recorded, and for how you use and share recordings and transcripts you make with Simbi. I accept no liability for recordings made in violation of applicable law.

3. Third-party services

Simbi depends on services I do not operate or control:

  • OpenAI. Simbi's transcription and intelligence features require the ChatGPT desktop app and a ChatGPT account, and they use your account and credentials. Your use of OpenAI's services through Simbi is governed by OpenAI's terms of use, and you are responsible for ensuring your use complies with them. OpenAI may change or discontinue APIs, endpoints, or account features at any time, which may break or degrade Simbi features without notice.
  • GitHub hosts Simbi's downloads and update feed.
  • Hugging Face hosts the speech models Simbi downloads on first run.

I make no promises about the availability, accuracy, or continuity of any of these services or of the Simbi features built on them.

4. No affiliation

Simbi is an independent project. It is not affiliated with, endorsed by, or sponsored by OpenAI, Apple, NVIDIA, GitHub, Hugging Face, or any other company named in the app or its documentation. ChatGPT, Codex, and all other trademarks are the property of their respective owners and are used only to describe compatibility.

5. Accuracy of transcripts and AI output

Transcription, speaker identification, summaries, and other AI-generated content are produced by machine-learning systems and will contain mistakes: mis-heard words, wrongly attributed speakers, and incorrect or incomplete summaries. Do not rely on them where accuracy matters without checking the original audio. You are responsible for reviewing AI output before acting on it or sharing it.

6. Your data

Simbi stores your notes, recordings, and transcripts as plain files on your Mac and sends content only to your own OpenAI account, as described in the Privacy Policy. You own your content; nothing in these terms gives me any rights to it. You are responsible for your own backups.

7. No warranty

SIMBI IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. I DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT RECORDINGS, TRANSCRIPTS, OR NOTES WILL NOT BE LOST OR CORRUPTED.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL I BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH SIMBI OR YOUR USE OF IT, INCLUDING LOSS OF DATA, LOST PROFITS, OR CONSEQUENTIAL DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

9. Changes

I may update these terms from time to time. The current version is always available in the Simbi repository and, when it exists, on the Simbi website. Continued use of the app after a change constitutes acceptance of the updated terms.
